DESCRIPTION:العنوان \nالتحكيم الالكتروني \nالملخص \nيعتبر التحكيم الالكتروني وسيلة من وسائل تسوية المنازعات قوامه الخروج عن طرق التقاضي العادية عبر وسائل الاتصالات الحديثة\, فهو نوع من العدالة الخاصة ينظمه القانون ويسمح بمقتضاه بإخراج بعض المنازعات عن ولاية القضاء العام في حالات معينة\, كي تُحل بواسطة أفراد عاديين يختارهم الخصوم كقاعدة\, وتُسند إليهم مهمة القضاء بالنسبة إلى هذه المنازعات \, ولهذا فقد أصبح من المستقر عليه اللجوء إلى التحكيم الالكتروني لتسوية منازعاتهم بدلاً من اللجوء إلى القضاء العادي\, وذلك نظراً لما يحققه هذا الطريق من ميزات عديدة تتمثل في السرعة في الفصل في المنازعات\, وقلة التكلفة الاقتصادية\, وحفظ الأسرار ومن ثم فقد أنشئت مراكز متخصصة للتحكيم في مختلف الدول كي تُلبي حاجة التجارة الالكترونية في ظل الانفتاح الاقتصادي الذي يشهده العالم اليوم\, الذي يعيش ثورة المعلوماتية التي من أبرز معالمها ظهور الشبكة العالمية للمعلومات (الإنترنت) بما تقدمه من سهولة للاتصال وتقديم الخدمات وإنجاز المعاملات في المجالات كافة ومنها المجال القانوني\, حيث ظهر ما يُعرف بقانون الفضاء الإلكتروني الذي يتناول العديد من المواضيع مثل التجارة الإلكترونية والملكية الفكرية وجرائم الفضاء الإلكتروني وغيرها \, لقد حاولنا اعطاء نبذة مختصرة عن ماهية التجارة الالكترونية والتحكيم الالكتروني \, ومن ثم ألقاء الضوء على دور التحكيم الالكتروني في تسوية المنازعات الناشئة في الوسط التجاري الالكتروني\n \nالتاريخ: 30\5\2022 \nالموقع: 8303
